Rule Chapter, Title, and Subject: Chapter 3321.0100 to 3321.1400: Possible Rule Amendment to Rules Governing Vending Stands and Business Enterprises-Services for the Blind
Reason for Rulemaking: This Rule has not been updated since 1990 and requires change. The department is interested in removing and updating archaic language; clarifying terms and processes; ensuring consistent use of terminology; modifying rule format; and considering policy changes. Comments on other areas of the current rule are welcome but will only be considered for this rule revision as the agency has time.
Advisory Committee: The department does plan to appoint an advisory committee to comment on the possible rules. The advisory committee will consist of the Operator Management Committee, an elected body representing all current licensed blind vendors operating vending stands and business enterprises in the Business Enterprises Program. The Operator Management Committee is constituted pursuant to Code of Federal Regulations, title 34, section 395.14, to, among other duties, “…actively participate with the State licensing agency in major administrative decisions and policy and program development decisions affecting the overall administration of the State's vending facility program.” The advisory committee is expected to commence and finish its work in June 2012.

Rule Chapter, Title, and Subject: Chapter 3325.0100 to 3325.0490: Possible Rule Amendment to Rules Governing Rehabilitation Services to the Blind and Visually Impaired
Reason for Rulemaking: State Services for the Blind (SSB) provides rehabilitation services to blind and visually impaired individuals. SSB is considering rule amendments and repealing some rule parts. The rules were developed and implemented in 1986, and have not been changed since. In the meantime, federal law, state policies and budgets, and the application of best practices have caused change. SSB is interested in conforming rule parts to federal law and regulations; restructuring the self-care and independent living rule parts; clarifying and streamlining rule parts, including those related to the purchase, maintenance and ownership of technology aids and devices; strengthening requirements related to adjustment to blindness training; and repealing rule parts related to direct rehabilitation services to children.
Advisory Committee: SSB is forming an advisory committee which will include representatives of the State Rehabilitation Council for the Blind, American Council of the Blind of Minnesota, National Federation of the Blind of Minnesota, United Blind of Minnesota, BLIND, Inc., Duluth Lighthouse for the Blind, Vision Loss Resources, SSB staff and the Client Assistance Project.
