Permanent Employment (PERM) Process

Effective March 28, 2005, all applications for permanent foreign labor certification must be filed directly with the U.S. Department of Labor. For the basic labor certification process, an employer must file a completed Department of Labor Application for Permanent Employment Certification (ETA Form 9089). For employment in Minnesota, the application must be filed with the following Employment and Training Administration (ETA) processing center:

Consult the Department of Labor site for filing instructions and the application form.

The employer must obtain a prevailing wage determination from the Minnesota state workforce agency and place a 30-day job order in MinnesotaWorks prior to filing the labor certification application.
